TERMS AND CONDITIONS

To cover the full scope of managing restaurants, we have created certain add-ons that restaurateurs can avail of by paying through an online payment gateway. Below are the Terms and Conditions for the same.

1. Introduction

These Terms of Service (the "Terms") are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the website at www.restomate.cloud (the "Site") and any related mobile or software applications, whether existing now or in the future ("the App"), owned and operated by Restomate ("We," "Us," "Our," "Company").

By downloading or otherwise accessing the App, you agree to be bound by the following terms and conditions ("Terms"), privacy policy, and License Agreement. If you have any queries about the App or these Terms, you can contact Us using the information provided in paragraph 11 of these Terms. If you do not agree with these Terms, you should stop using the App immediately.

2. Definitions

  • "Services" will include business applications such as a Feedback Management Mobile App and a Waiting Queue Management Mobile App, which are integrated with the Restomate POS.
  • "Content" refers to the materials created by Restomate and made available in connection with the Services, including but not limited to visual interfaces, interactive features, graphics, designs, compilations, computer code, products, software, functionalities, aggregate ratings, reports, and other usage-related data in connection with activities associated with your account.
  • "Your Content" or "User Content" means content that you upload, share, or transmit through the Services, such as likes, ratings, reviews, images, photos, messages, customer information, and any other materials you provide.

3. General Rules Relating to Conduct

  • The App is made available for your personal use. We grant you a personal, limited, non-exclusive, and non-transferable license to access and use the Services only as expressly permitted in these Terms.
  • You shall not use the Services for any illegal purpose or in any manner inconsistent with these Terms. When you use the App, you must comply with all applicable laws and regulations.

4. Intellectual Property Rights and Content

  • We are the sole and exclusive copyright owners of the Services and Our Content. We also exclusively own the copyrights, trademarks, service marks, logos, trade names, trade dress, and other intellectual and proprietary rights associated with the Services and Our Content. All rights are reserved.
  • By submitting Your Content, you grant Us a perpetual, irrevocable, non-exclusive, royalty-free right to use Your Content for any purpose, including API partnerships with third parties and in any media existing now or in the future.

5. Free Trial and Fees

  • You may start using Our App with a free trial. The free trial period lasts for one week or as otherwise specified during sign-up and is intended to allow you to try the service. We will bill your Payment Method for your yearly membership fee at the end of the free trial period unless you uninstall the App before the end of the free trial period.
  • You may cancel your membership at any time. However, we do not provide refunds or credits for partial membership periods.

6. Restomate Privacy Policy

We take your privacy very seriously. Restomate will only use your personal information in accordance with our privacy policy. By using the App, you acknowledge and agree that you have read and accept the terms of our privacy policy and these Terms.

7. Disclaimer/Liability

USE OF THE APP IS AT YOUR OWN RISK. THE APP IS PROVIDED ON AN "AS IS" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  1. RESTOMATE DISCLAIMS ALL LIABILITY WHATSOEVER, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE IN RELATION TO THE APP; AND
  2. ALL IMPLIED WARRANTIES, TERMS, AND CONDITIONS RELATING TO THE APP ARE HEREBY EXCLUDED.

8. Service Suspension

Restomate reserves the right to suspend or cease providing any services relating to the App with or without notice and shall have no liability or responsibility to you if it chooses to do so.

9. General

  • These Terms constitute the entire agreement between you and Restomate concerning your use of the App. Restomate reserves the right to update these Terms from time to time. If updated, the new Terms will be effective immediately.
  • These Terms shall be governed by and construed in accordance with Indian laws, and you agree to submit to the exclusive jurisdiction of Ahmedabad, Gujarat, India.
  • If any provision(s) of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed to reflect the intentions of the parties, and all other provisions shall remain in full force and effect.
  • Restomate's failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Restomate in writing.
