CANCELLATION & REFUND POLICY

(FOR OUTSIDE INDIA CUSTOMERS)

We, Synergetix AI Solutions Private Limited ("We", "Us", "Our", "Company"), operate a cloud-based point-of-sale software application under the brand name "Restomate" for restaurants. This platform offers integrated services such as mobile and card payments, inventory management, discounts, ordering and delivery apps, table reservations, supplier marketplace, and analytics, utilizing a programmable API framework. Through the Restomate platform and associated websites (collectively referred to as "Restomate Platforms"), we provide comprehensive restaurant management solutions to restaurants and food outlets. The Restomate Platforms are developed and owned by the Company and are licensed under various subscription plans for a fee.

The subscription to the Restomate POS platform and its additional services ("Restomate Subscription") is subject to our Terms of Service, which you ("User", "You", "Your") agree to upon subscribing. You can choose a subscription plan that suits you and make payments using the available payment methods.

Fees

You are required to pay a subscription fee based on the selected Restomate Subscription plan ("Subscription Fee"). The Subscription Fee, as outlined in different subscription plans, is non-refundable. Refunds for food services on our platform are not available, except as expressly provided in this Cancellation & Refund Policy. Applicable taxes may be levied on the subscription fee. Your paid Restomate Subscription will be activated only after successful payment as per your chosen subscription plan.

Subscription Cancellation & Refund

You may cancel your paid Restomate Subscription at any time by accessing your account settings on any of the Restomate Platforms. If cancellation occurs within 15 business days of subscribing, we will issue a credit note and provide a full refund, deducting any benefits utilized during this period. If you cancel an annual subscription at any other time, we will issue a credit note and refund the Subscription Fee based on your usage of the Restomate platform.

For monthly subscriptions, refunds will only be processed if you have not used or availed any benefits since making the payment.

Revisions

We reserve the right to modify the Terms of Service and this Cancellation & Refund Policy or any aspect of the Restomate Subscription without prior notice. If any change is deemed invalid or unenforceable, the remaining terms remain in effect. Your continued subscription after any modifications constitutes acceptance of the changes. If you do not agree with any changes, you must cancel your subscription.

Termination by Us

We reserve the right to terminate your Restomate Subscription at our discretion without prior notice. In such cases, we will issue a credit note and provide a prorated refund based on the remaining term of your subscription. However, refunds will not be provided if termination is due to a violation of our Terms of Service, applicable laws, fraudulent activity, misuse, or actions harmful to our interests or other users. Failure to enforce strict compliance with these terms does not constitute a waiver of our rights.

Limitation of Liability

IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN OUR CONDITIONS OF USE AND SALE, WE AND OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES ARISING FROM OR RELATED TO THE RESTOMATE PLATFORMS. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL NOT EXCEED THE LAST SUBSCRIPTION FEE YOU PAID. THESE EXCLUSIONS AND LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE THE CANCELLATION OR TERMINATION OF YOUR RESTOMATE SUBSCRIPTION.
